Sealed. There is a rattling inside. I suspect some of the prongs that hold the CD in place are off. The CD is not moving though, just some loose prongs. from collection of a smoker. no smell of smoke to item, however it's possible that the cardboard slip might have some smell of cigarette when it is opened. impossible to tell without breaking the cellophane seal
